Erie County DA's Office Appointed as Special Prosecutor in Monroe County Attempted Assault Case

Erie County District Attorney John J. Flynn announces that his office has been appointed as the Special Prosecutor to oversee the case against 43-year-old David G. Jakubonis of Fairport, New York. The order was granted by Acting Supreme Court Justice Hon. Richard M. Healy after the Monroe County District Attorney's Office requested the appointment of a Special District Attorney.

It is alleged that on July 21, 2022, at approximately 7:50 p.m., the defendant attempted to cause physical injuries to the victim by means of a deadly weapon or dangerous instrument. The defendant allegedly walked onto a stage and approached the victim who was giving a speech at an event on Macedon Center Road in the Town of Perinton. It is further alleged that the defendant raised his hand, while armed with a set of self-defense knuckles with two pointed sharp edges, and swung at the victim's throat. The victim allegedly grabbed the defendant's wrist in an effort to prevent the attack until the defendant was detained and taken into custody by the Monroe County Sheriff's Office.

Jakubonis was arraigned the following morning before Perinton Town Court Justice Hon. Charles D. Steinman on one count of Attempted Assault in the Second Degree (Class "E" felony). The defendant was released on his own recognizance as the state charge is a non-qualifying offense for bail. Justice Steinman issued a temporary order of protection on behalf of the victim.

Jakubonis is scheduled to return to Perinton Town Court on Tuesday, August 30, 2022 at 3:00 p.m. for further proceedings.

If convicted of the charge, Jakubonis faces a maximum sentence of 4 years in prison.

The case will be prosecuted by Assistant District Attorney Stanislaw Makowski of the ECDA Felony Trials Bureau.

As are all persons accused of a crime, the defendant is presumed innocent until proven guilty in a court of law.
