Louisiana Legislature Enacts Adjuster Communication Requirements for Disaster Claims

The Louisiana State Legislature has enacted Senate Bill 198 (Act 263), outlining adjuster communications requirements for certain residential insurance claims. The bill was signed by the Governor on June 3, 2022, and it will become effective on August 1, 2022.

According to the bill, for a personal residential insurance claim that arises due to a named storm or hurricane for which a state of emergency or disaster is declared, and the insurer within a six month period assigns a third or subsequent claims adjuster to be primarily responsible for the insurance claim, the insurer shall provide the policyholder with specified information in a timely manner, including a written status report, the designation of a primary contact, and two or more direct means of communication with the primary contact.
