Committee on Transport Notes Judgement on Administrative Adjudication of Road Traffic Offences Act

MEDIA STATEMENT: COMMITTEE ON TRANSPORT NOTES JUDGEMENT ON ADMINISTRATIVE ADJUDICATION OF ROAD TRAFFIC OFFENCES ACT

Parliament, Friday, 14 January 2022 - The Chairperson of the Portfolio Committee on Transport, Mr Mosebenzi Zwane, has noted the Pretoria High Court's judgement regarding the Administrative Adjudication of Road Traffic Offences (AARTO) Act.

The court found the Act to be inconsistent with the constitution and declared it invalid in its entirety. Mr Zwane said the committee will read the judgment and thereafter enter into a discussion with the department. "Legislation must serve and better the lives of people it is meant to service. This was the thinking and approach behind the AARTO Act," he said.

The AARTO Amendment Act was meant, among other things, for the apportionment of penalties, the introduction of an infringement tribunal, the implementation of the demerit system and the rehabilitation of road traffic offenders.

Mr Zwane said the act was meant to decisively address the carnage on the road through improved administrative adjudication. The AARTO Amendment Act was piloted in Johannesburg and Pretoria, with the intention to roll out national implementation.
