Akin Gump International Arbitration Lawyers Analyze Concurrent Delays in International Construction Law

Akin Gump international arbitration partner Hamish Lal, counsel Brendan Casey and associate Léa Defranchi have written a chapter, titled "Comparative Approaches to Concurrent Delay" in Global Arbitration Review's "Guide to Construction Arbitration - Fourth Edition." This is an update to the chapter in the publication's third edition in 2019.

The chapter discusses concurrent delay - "one of the most complex substantive issues in international construction law" - and varying approaches to the issue in different jurisdictions, as it relates to construction arbitration and international construction law.

If no express definitions of concurrent delay are established, the authors note, tribunals will use the term to mean "the occurrence of delay to completion of the works caused by two or more delay events that are the responsibility of the employer and the contractor respectively."

Relevant parties may "define both concurrent delay and address how concurrent delay ought to be evaluated" but "many jurisdictions give entitlement to the contractor when there is concurrent delay to completion."
