New York-Chicago Team Secures Significant Decrease in Award in Damages-Only Jury Trial

Larry Lum (Partner-New York, NY) and Cameron Wall (Associate-Chicago, IL) secured a favorable verdict for a major pharmaceutical and medical device manufacturer client in a damages-only jury trial stemming from an automobile liability matter in McHenry County Circuit Court in Illinois. Seven years ago, the plaintiff was alleged to be seriously injured when her pick-up truck was struck from behind by a vehicle belonging to the firm's client. Summary judgment was granted on liability four years before the damages trial. She underwent back surgery and is now claiming a chronic back condition that will likely require further surgical intervention and ultimately a fusion. She was earning more than $100,000 in annual wages and health benefits and remained out of work since the accident; her economist blackboarded $3.5M in lost earnings. The plaintiff's attorney requested $8.5 million in damages from the jury; the jury returned a verdict award of $33,848.
