Cook and High's District Court Dismissal Affirmed on Appeal

William Cook (Partner-Michigan) and Matthew High (Associate-Michigan) obtained an affirmation of a district court dismissal from the 6th Circuit Court of Appeals in an antitrust case against Wilson Elser's client, a nonprofit organization and developer of voluntary performance and test standards for athletic equipment used in oversight by athletic regulatory bodies. The other defendants were helmet manufacturers. The plaintiff makes and sells a football helmet accessory and alleges our client and the other defendants are engaged in a conspiracy to limit competition and restrain trade in the helmet market and are guilty of tortious interference in the plaintiff's business relationships. The District Court dismissed the case as plaintiff failed to prove the alleged conspiracy or any harm allegedly done to its business or helmet accessory by our client or the other defendants.
