Tuberville Demands Answers on Biden Administration’s Radical Rewrite of Title IX
WASHINGTON - U.S. Senator Tommy Tuberville (R-AL) sent a letter to U.S. Secretary of Education (ED) Miguel Cardona investigating possible outside influences behind ED's recent finalized Title IX rule that impacts Title IX and women and girls across the country. Specifically, the finalized rule redefines gender and forces schools to allow males in spaces and activities designed for females. Senator Tuberville has been a leading voice in opposing the Biden administration's attempts to destroy Title IX.
Senator Tuberville is requesting answers to the following questions by May 22:
- Please list by name and position the individuals who drafted, edited, contributed to, approved, or who otherwise had input in the drafting of the rule.
- Please provide the names of any non-governmental groups that were consulted with, assisted with, or who otherwise participated in the drafting of the rule.
- Please provide copies of all drafts of the rule.
- Please provide all memoranda, correspondence including email, and supporting documents that were used or consulted in the drafting of this rule.
- Please provide an explanation of the process and timeline for reviewing all 240,000 public comments.
- Please provide an explanation of how the feedback from these comments was weighed.

BACKGROUND:
As a former educator, mentor, and coach for more than 40 years, Senator Tuberville is concerned about the future of girls' and women's sports. He began his career coaching high school girls' basketball shortly after the enactment of Title IX and witnessed the law's positive impacts firsthand. Senator Tuberville has been a vocal advocate of preserving Title IX and urged Joe Biden's Department of Education officials to keep the protections in place.
In June 2022, on the 50th anniversary of Title IX's enactment, the U.S. Department of Education issued a proposed rule to allow biological males to compete in women's sports. Senator Tuberville urged Joe Biden's Department of Education officials to keep the protections in place and cited his concern about the negative implications it would cause for female athletes.
In April 2024, the Biden administration finalized one of two expected rules impacting Title IX. Senator Tuberville issued a scathing statement.
In March, Senator Tuberville forced a vote on an amendment that would protect female athletes by keeping men out of women's sports - 51 Democrats voted to block the amendment from proceeding. Sen. Tuberville originally introduced the Protection of Women and Girls in Sports Actin 2022, but Senator Chuck Schumer (D-NY) has refused to bring it to the floor for a vote. Sen. Tuberville put 51 Democrats on record voting against protecting women's sports.
In March, Senator Tuberville and Senator Bill Cassidy (R-LA) sent a letter to the National Collegiate Athletics Association (NCAA) seeking more information on its policies related to transgender athletes and asking if the NCAA has ever taken action against violations of these policies.
Also in March, Senator Tuberville hosted a roundtable with former NCAA athletes, parents, and coaches to discuss the importance of saving women's sports. Former host of SportsCenter, Sage Steele, moderated the discussion wand Senators Katie Britt (R-AL), Cindy Hyde-Smith (R-MS), and Cynthia Lummis (R-WY) also joined. Senator Tuberville and Sage Steele also penned an op-ed recapping the roundtable.
In February, Coach Tuberville introduced a bill to ban men from competing in women's U.S. Olympic sports. Coach's bill came after USA Boxing announced it would allow men to box against women.
