Police - Media Releases 4/11/2021 Man Jailed After Fighting with Officers Over a Gun on a Downtown Street Early Today

Two officers' response to a fight call at 2nd Avenue & Broadway just before 1 a.m. today quickly turned extremely dangerous as they wound up having to battle with one of the parties over a pistol, which discharged into the street during the struggle.

Wilfredo Gonzalez III, 25, of Hendersonville, is presently jailed in lieu of $100,000 bail on two counts of felony aggravated assault against Officers David Studer and Jason Smith.

Studer and Smith were in full uniform working as part of the police department's Entertainment District Initiative when they were notified of a fight at 2nd Avenue and Broadway. As they approached, they could see a man holding down Gonzalez. The man told the officers that Gonzalez had a gun. As Officer Studer attempted to pick up a pistol that was lying in the street next to Gonzalez, Gonzalez suddenly grabbed it. The officers ordered him multiple times to drop the pistol. Instead, Gonzalez fought with Studer and Smith over the gun. During the struggle, it discharged into the pavement of 2nd Avenue a few feet in front of them. After additional commands for him to drop the pistol, Gonzalez relented and was placed under arrest.

No citizens or officers were injured by the shot.

The circumstances surrounding the initial fight call are not known. The man who was holding Gonzalez down when officers arrived left the immediate area during the struggle over the gun.
