Tuberville Demands Answers From NCAA, Dept of Ed on Title IX

WASHINGTON - Today, U.S. Senator Tuberville (R-AL) and Senate Health, Education, Labor, and Pensions (HELP) Committee Ranking Republican Senator Bill Cassidy, MD (R-LA) sent a letter to the National Collegiate Athletics Association (NCAA) seeking more information on its policies related to transgender athletes and asking if the NCAA has ever taken action against violations of these policies. Additionally, Senator Tuberville and Senator Cassidy requested information from the Department of Education, asking whether it has provided guidance to schools, athletic associations, or other stakeholders to influence decisions on transgender athletes in line with its proposed Title IX rule.

Senator Tuberville has been a vocal advocate of preserving Title IX. As a former educator, mentor, and coach for more than 40 years, Senator Tuberville is concerned about the future of girls' and women's sports. He began his career coaching high school girls' basketball shortly after the enactment of Title IX and witnessed the law's positive impacts firsthand.

These letters follow the first round of updates from Dr. Cassidy and the HELP Committee staff's investigation into the impact of President Biden's proposed Title IX reforms allowing biological males to compete in women's sports.

BACKGROUND

Last week, Senator Tuberville hosted a roundtable with former NCAA athletes, parents, and coaches to discuss the importance of saving women's sports. Former host of SportsCenter, Sage Steele, moderated the discussion wand Senators Katie Britt (R-AL), Cindy Hyde-Smith (R-MS), and Cynthia Lummis (R-WY) also joined.

In February, Coach Tuberville introduced a bill to ban men from competing in women's U.S. Olympic sports. Coach's bill came after USA Boxing announced it would allow men to box against women.

In April 2023, Senator Tuberville reintroduced the Protection of Women and Girls in Sports Actto strip away funding from schools that allow biological males to participate in female sporting events. The U.S. House of Representatives passed this legislation, but Senate Democrats blocked it when Senator Tuberville brought it up for a vote on the Senate floor.

In June 2022, on the 50th anniversary of Title IX's enactment, the U.S. Department of Education issued a proposed rule to allow biological males to compete in women's sports. Senator Tuberville urged Joe Biden's Department of Education officials to keep the protections in place and cited his concern about the negative implications it would cause for female athletes.
