The City of Fargo Updates Fencing Requirements for Residential Swimming Pools and Hot Tubs

The Inspections Department to begin enforcing the updated safety requirements Summer 2024

04/25/2024

The Fargo City Commission recently updated the Fargo Municipal Code related to safety requirements for fencing around private residential swimming pools and hot tubs. The Inspections Department will begin enforcing the updated code this summer.

The updated code clarifies what enclosures are acceptable and where to place them. The revisions were taken directly from certain sections of the 2021 International Swimming Pool and Spa Code that Fargo had not previously adopted. The updated requirements now include:

• Any temporary or permanent pool or hot tub that has water with a depth of two feet or more must have a fence/barrier.
• The fence must have a minimum height of four feet.
• The fence must be installed at least four feet away from the edge of the pool or hot tub.

All the requirements of the updated code (Ordinance No. 5425) can be found online. Residents with questions should contact the Inspections Department at 701.241.1561 or through The City of Fargo website.
