Town Council Public Hearing 2/15 on Ethics Ordinance Amendment

The Bar Harbor Town Council will hold a public hearing Tuesday, February 15 at 7:00 p.m. by videoconference to consider the following proposed amendment to Chapter 78 of the Bar Harbor Town Code. Comments may be made by joining the Zoom webinar and using the raise hand function.

An amendment to add the Town of Bar Harbor Social Media Policy to the Ethics Ordinance.

The Town of Bar Harbor hereby ordains that Chapter 78, Ethics of the Town Code is amended as follows:

§ 78-15Code of Ethics education.

A. Every member shall participate in Ethics Ordinance training, as prescribed by the Town Council, within six months of appointment and every three years thereafter.

B. The Town Clerk shall furnish each new member with a copy of the Code of Ethics before the member begins the duties of the member's office.

C. A signed receipt for all copies shall be returned to the Town Clerk, who shall retain the receipt on file.

§ 78-16. Social Media Policy.

  1. Every member shall adhere to the Town of Bar Harbor Social Media Policy. A violation of the Social Media Policy may be enforced pursuant to this Code of Ethics.

§ 78-17Ethics enforcement procedures.

  1. Ethics Commission creation; membership; terms of office. There is hereby created a Town of Bar Harbor Ethics Commission, the voting membership of which shall include the current Chair and Vice Chair of the Town Council, Superintending School Committee and Warrant Committee, as well as the Secretary of the Warrant Committee. Should any of the above individuals be unwilling or unable to serve on the Ethics Commission, a replacement shall be appointed by their respective board (i.e., Council, School Committee or Warrant Committee) from within the board's membership. In the event that the Commission is processing an ethics complaint at the end of a member's elected term of office, either on their respective board or as an officer of their respective board, their term on the Ethics Commission shall continue until the Commission has filed its final report regarding the complaint.
