The Iowa State Bar Association Board of Governors approves updates to civil jury instructions

The Iowa Jury Instructions Committee of The Iowa State Bar Association (ISBA) submitted the following changes and additions to the Iowa Civil Jury Instructions. The changes were approved by the ISBA Board of Governors at the March meeting.

Proposed Amendments to Iowa Civil Jury Instruction Nos. 3120.1, .2, .4, and .5, Employment Law Instructions. The Committee approved proposed amendments to Civil Jury Instruction Nos. 3120.1, .2, .4, and .5. These instructions address Workplace Harassment/Hostile Work Environment in both direct and indirect liability situations. They also provide citation updates to the definitions of Supervisor and Unwelcome Conduct. The "redline" and clean versions of these proposed amended instructions are attached to the minutes as Attachment A and Attachment B, respectively. The Committee respectfully recommends the Board of Governors approve the proposed amendments to Uniform Civil Jury Instruction Nos. 3120.1, .2, .4, and .5.

Proposed Amendment to Iowa Civil Jury Instruction No. 900.6, Known or Obvious. The Committee approved a proposed amendment to Civil Jury Instruction No. 900.6. The amendment is the addition of a Comment indicating the instruction should not be used when comparative fault is alleged. The "redline" and clean versions of these proposed amended instruction are attached to the minutes as Attachment C and Attachment D, respectively. The Committee respectfully recommends the Board of Governors approve the proposed amendment to Uniform Civil Jury Instruction No. 900.6.
