SETBACK VARIANCE APPLICATION

The Cadillac Zoning Board of Appeals will conduct a public hearing at its regularly scheduled meeting on Thursday, May 16th, 2024, at 5:30 p.m. at the Cadillac Administrative Office, 200 North Lake Street, Cadillac, Michigan 49601 for the receipt of comment on an application filed by Linda Sniegowski, trustee/beneficiary of 1202 Sunnyside Drive. The property is zoned R-1, One-Family Residential District. The property is described as W 60 FT. OF E 123 FT. OF A PARCEL OF LAND COM. AT AN IRON STAKE ON N BDY. OF BLVD: S 82DEG 5MIN E 528 FT. FROM PT. WHERE BLVD. INT. N & S 1/4 LINE OF SEC. 8-21-9: N 0DEG 30MIN W 374 FT. TO LAKE CADILLAC: N 76DEG E 55 FT. 4 INS: S 66DEG E 314 FT: S 0DEG 30MIN E 304 FT: N 82DEG 45MIN W 345 FT. 4 INS. Section 46-656(1) of the Cadillac Zoning Ordinance stipulates that where a building accessory to a residential building is structurally attached to a main building, it shall be subject to, and must conform to, all regulations applicable to main buildings. The applicant requests a variance from the provisions of Section 46-656(1) seeking authorization to connect an existing detached garage to the dwelling at 1202 Sunnyside Drive. The project includes the expansion of the dwelling with the construction of a handicapped accessible living area addition that will connect the existing dwelling and garage. The purpose of the connection is to provide an opportunity for the efficient, safe, and sheltered travel of a wheelchair bound occupant between the home and garage during periods of inclement weather. The side yard setbacks of the existing detached garage ranges from 3 to 4 feet. Section 46-629, Schedule of Regulations, of the ordinance requires a minimum side yard setback of 10 feet for accessory buildings if attached to a main building. The applicant wishes to maintain the existing setbacks of the garage and is requesting relief from the provisions of Section 46-656(1) and from the 10 feet side yard setback requirement of Section 46-629 of the Cadillac Zoning Ordinance. If the application is denied, the applicant wishes to proceed with construction of the handicapped accessible living area based on a modified design. Under the design, the applicant requests the addition be approved with side yard setbacks from the east property line of 12 feet and 10 feet. The R-1 District requires a setback of 15 feet. The addition includes the southerly expansion of the existing dwelling for a distance of 30 feet from the east wall. The proposed setbacks of the addition from the east wall are 12 feet for the first 20 feet of the expansion and 10 feet for the remaining 10 feet of the addition. These reflect side yard setback variances of 3 feet and 5 feet respectively.

The application may be reviewed at the city offices at 200 N. Lake Street between the hours of 9:00 a.m. and 5:00 p.m. Questions or written comments regarding the above application should be directed to the Community Development Department, 200 N. Written comments must be received at the Cadillac Administrative Offices no later than 5:00 p.m. of the public hearing date to be included in the public hearing record.
