CHARLOTTE COMMERCIAL CANNABIS PROGRAM

The City of Charlotte recently adopted ordinances and created zoning districts intended to facilitate the development of commercial cannabis operations.

Prospective Commercial Cannabis operators should familiarize themselves with both the Commercial Cannabis Zoning Ordinance, and theCommercial Cannabis General Law Ordinance. Both ordinances apply to all commercial cannabis operations in the City.

Prospective Commercial Cannabis operators should be familiar with all aspects of the Michigan Regulation and Taxation of Marihuana Act, and the Medical Marihuana Facilities Licensing Act. Please note that certain elements of, and information included, in the state-level license application are required to be submitted with your Municipal License Application.

Commercial Cannabis operations are only permitted in certain areas of the City. Prospective Commercial Cannabis operators should consult the relevant zoning maps to ensure the property they propose for locating a commercial cannabis operation is located in the appropriate overlay zoning district. If you are uncertain as to whether a property is inside a cannabis district, or not, please contact Community Development Director Bryan Myrkle at (517) 543-8853 or [email protected] for confirmation.

The four types of licenses available in Charlotte are Processor, Secure Transporter, Retail/Provisioning Center, and Safety Compliance Facility. Please note that commercial cannabis growing operations are not permitted in the City of Charlotte.

When you are ready to apply for a local commercial cannabis license, you can download the application materials here. The pdf form is fillable, but if you need additional space to complete one of the fields, please feel free to attach additional pages as may be necessary to provide complete application. Hand-filled forms will be accepted, but all applicants are encouraged to submit typewritten applications. Please note that in addition to the printed, original copy of the application materials, a complete electronic copy of the application is also required. It should be submitted on a USB Flash Drive if possible.

The City of Charlotte will be appointing a Cannabis License Appeals Board to hear and adjudicate appeals related to denial of initial licensure, suspension, revocation or non-renewal of licensure. The City of Charlotte will also adopt and publish Rules for Appeal that will direct and advise the activities of this Board.

City of Charlotte staff is available to consult with you prior to making application so as to ensure the greatest chance of success when applying for a license. While not required, it would be very helpful to both City staff as well as applicants to make an appointment for when you want to turn in the application.
