Project Description:

Perform maintenance on an existing concrete-coated twenty-six (26) inch-diameter natural gas pipeline, which extends sixteen (16) miles across New York State waters, including the Raritan Bay, Lower New York Bay, and a portion of the Atlantic Ocean. Approximately 28,980 cubic yards (cy) of rock cover will be placed over 9.24 acres in New York State waters to cover portions of the pipeline that have been exposed due to scour erosion of the seabed. An additional 0.06 acres of temporary disturbance may occur due to the placement of spuds and barge anchors.

The project will result in the permanent loss of 9.24 acres of Atlantic sturgeon habitat. This habitat impact will be offset through completion of the Net Conservation Benefit Project (NCBP) which will satisfy the requirements of ECL ยง 11-0535 and 6 NYCRR Part 182. The NCBP will fund a multi-year research project designed to characterize sturgeon habitat, and study the movement of sturgeon throughout the New York harbor to inform recommendations to reduce risk of sturgeon mortality as well as inform restoration priorities.

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

State Historic Preservation Act (SHPA) Determination:

Evaluation using a Structural-Archaeological Assessment Form or other information has concluded that the proposed activity will not impact registered, eligible or inventoried archaeological sites or historic structures.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.
