Statement on Bureau of Development Services letter regarding warehouse development at 12350 NE Sandy

The Bureau of Development Services recently sent a letter recommending a temporary halt to construction activity while an appeal to the Oregon Land Use Board of Appeals is pending.

Development Services issued a commercial building permit in November 2023 for the construction of a new warehouse at 12350 NE Sandy Blvd. The issuance of a permit authorizes construction to proceed, though the permit was later appealed to the Oregon Land Use Board of Appeals (LUBA). LUBA agreed to consider the appeal.

As a matter of caution, Development Services sent a letter to RFC Joint Venture and HFK Realty Partners, the property owner and its agent, advising-but not requiring-a temporary cessation of construction activities until LUBA issues its ruling on this matter. The letter was also sent to the permit applicant, Faster Permits. It is solely at the discretion of the property owner to decide whether to halt construction activities at this site.

There is no anticipated date for a hearing by, or ruling from, LUBA on this matter. A copy of the letter is available to download below.
