Project Description:

The applicant is proposing to replace the existing 96" culvert with a series of 4 aluminized steel culvert pipes (3x 72-inch diameter and 1x 96-inch diameter) to improve the connectivity between Port Bay and the Beaver Creek wetland; each pipe will be 72 feet long with 12" stone fill placed above and on the sides of the pipe. The project will result in 707 CY of excavation below Mean High Water (MHW), 438 CY of temporary fill below MHW, and 227 CY of permanent fill below MHW. The entire project area south of West Port Bay Rd is within NYSDEC regulated Class 1 Freshwater Wetland NW-5; the remaining project area is within the associated 100-foot wetland Adjacent Area. Additionally, the project area is in Beaver Creek, a navigable Class C stream, and the NYSDEC Lake Shore Marshes Wildlife Management Area.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was performed.

SEQR Lead Agency: Huron Town Board

State Historic Preservation Act (SHPA) Determination:

Evaluation using a Structural-Archaeological Assessment Form or other information has concluded that the proposed activity will not impact registered, eligible or inventoried archaeological sites or historic structures.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Apr 25, 2024.
