[SUPREME] Brione Donta Jackson v. State of Indiana, No. 22A-CR-02524

The State charged Jackson with possession of a firearm by a serious violent felon after police found a firearm while searching his trunk. Jackson moved to suppress the firearm and any statements he made following its discovery, arguing the officers lacked reasonable suspicion to search his trunk based on the smell of burnt marijuana in the passenger compartment. The Hamilton Superior Court denied Jackson's motion. On interlocutory appeal, the Court of Appeals affirmed.Jackson v. State, No. 22A-CR-2524 (Ind. Ct. App. 2023), trans. pending. Jackson has filed a petition to transfer and asked the Indiana Supreme Court to assume jurisdiction over the appeal.
