ERO Denver arrests 9 at-large noncitizens who violated conditions of Alternatives to Detention

DENVER - U.S. Immigration and Customs Enforcement (ICE) Enforcement and Removal Operations (ERO) officers in the Denver area of operations covering Colorado and Wyoming apprehended nine unlawfully present noncitizens who violated the conditions of their release in the Alternatives to Detention (ATD) program during a local operation April 1-5.

"Noncitizens who abscond and violate the conditions of their release in the Alternatives to Detention program will be apprehended," said ERO Denver acting Field Office Director Arthur J. Wilson Jr. "This program is a privilege, and when it is abused, there will be consequences."

Those arrested include:

• A 25-year-old citizen of Nicaragua in Denver. Since being enrolled in the ATD program in Oct. 2022, this individual has had one violation for an arrest for felony menacing-real/simulated weapon and weapon-prohibited use-drunk w/gun. This individual was arrested in possession of a firearm and narcotics and will remain in ICE custody pending removal proceedings.
• A 36-year-old citizen of Mexico in Denver. The Denver County Court convicted this noncitizen of driving while ability impaired. This individual was enrolled in the ATD program in January 2014 and has since accumulated 100 violations of the program. ICE ERO ATD Unit effectuated an arrest on April 1, and this noncitizen was as removed from the United States to Mexico on April 9.
• A 48-year-old citizen of Mexico in Denver. The Denver County Court convicted this noncitizen of driving while ability impaired. This individual was enrolled in the ATD program in July 2014 and has since accumulated 27 violations of the program. ICE ERO ATD Unit effectuated an arrest on April 1, and this noncitizen was removed from the United States to Mexico on April 9.
• A 23-year-old citizen of Venezuela in Denver. This noncitizen was enrolled in the ATD program in September 2023 and has since accumulated 49 violations of the program. ICE ERO ATD Unit arrested this noncitizen April 1, and they will remain in ICE custody pending removal proceedings.

ICE focuses on the arrests of noncitizens who have committed crimes and other individuals who have violated our nation's immigration laws. ICE officers, informed by their experience and training, use their inherent discretion as law enforcement officials to focus enforcement resources on those who pose a threat to national security, public safety, or border security. These efforts include noncitizens with final orders of removal. Cases amenable to federal criminal prosecution may be presented to the appropriate U.S. attorney's office.

In fiscal year 2023, ERO arrested 73,822 noncitizens with criminal histories; this group had 290,178 associated charges and convictions with an average of four per individual. These included 33,209 assaults; 4,390 sex and sexual assaults; 7,520 weapons offenses; 1,713 charges or convictions for homicide; and 1,655 kidnapping offenses.
