What this is about

The Data Sharing and Governance Act Framework for sharing data builds upon the Data Sharing and Governance Act 2019 (DSGA) by setting out a common set of practices for all Public Bodies to follow when they wish to use the Act as their legal basis for sharing data. Under the Framework, data sharing agreements between public bodies for the purpose of sharing personal data will be made available for public consultation for a period of 28 days.

What we are consulting on

The Department of Agriculture, Food and the Marine (DAFM), intends to enter into a Data Sharing Agreement under the DSGA with the Department of Housing, Local Government and Heritage (DHLG&H), for the purposes of enabling the National Parks and Wildlife Service at DHLG&H comply with its obligations under the EU Habitats Directive and Wildlife Acts with respect to nature conservation objectives, particularly in relation to turbary rights on specific bogs.

The Department of Agriculture, Food and the Marine will provide land ownership and turbary right data to the DHLG&H which will be used in the administration of the Protected Raised Bog Restoration Incentive Scheme and the Protected Raised Bog Restoration Programme. It will assist the DHLG&H to identify landowners and turbary right holders in relation to its Protected Raised Bog Restoration Programme. This Data Sharing Agreement covers sharing of Personal Data, in limited circumstances, by the DAFM with DHLG&H for this purpose.

The start date for public consultation is 23 March 2023 and it will run for a period of 28 days. The public consultation will end on 20 April 2023. Submissions will not be accepted once the public consultation period has expired.

What will happen to what you say

We will consider your submission and may respond. Where the proposed parties consider it appropriate, they may also amend the proposed agreement to take into account your submissions. A copy of the Data Sharing Agreement and a summary of all submissions will be sent to the Data Governance Board.
