U.S. Security Associates, LLC, contracted with Perdue Farms, Inc., for security services. That contract required the parties to file any lawsuits arising from their agreement in Maryland. After an incident at the plant, Perdue filed suit in Daviess Circuit Court, which granted U.S. Security's and its employees' motion to enforce the forum-selection clause. On interlocutory appeal, the Court of Appeals reversed and remanded. Perdue Farms, Inc. v. L&B Transport, LLC, 217 N.E.3d 1267 (Ind. Ct. App. 2023), vacated. The Indiana Supreme Court has granted a petition to transfer and assumed jurisdiction over the appeal.
