Drinking Water State Revolving Fund (DWSRF)

The New York State Environmental Facilities Corporation (NYS EFC), the Department of Environmental Conservation (NYS DEC), and the Department of Health (NYS DOH) are pleased to announce the availability of funds in support of CWSRF and DWSRF eligible projects for Federal Fiscal Year (FFY) 2025. The CWSRF and DWSRF programs are available to municipalities and certain non-municipal entities in New York State to finance water quality and drinking water related projects. Eligible projects for which the required items have been submitted by the deadlines below will be listed in the CWSRF and DWSRF 2025 Draft IUPs.

Funding is now available from the CWSRF and DWSRF programs through the Infrastructure Investment and Jobs Act of 2021, also known as the Bipartisan Infrastructure Law (BIL), a five-year program approved by Congress and signed by the President in November 2021.

New project listing forms and project updates will be accepted through Friday, June 14, 2024, from municipalities interested in competing for:
• FFY 2025 CWSRF Base funding
• FFY 2025 CWSRF BIL General Supplemental funding
• FFY 2025 CWSRF BIL Emerging Contaminants (EC) funding
• FFY 2025 DWSRF Base funding
• FFY 2024 DWSRF BIL General Supplemental funding
• FFY 2024 DWSRF BIL EC funding
• FFY 2024 DWSRF BIL Lead Service Line Replacement (LSLR) funding

NYS EFC anticipates the CWSRF program will be able to provide approximately $1.5 billion in interest-free or low-interest rate financing and additional subsidy for clean water project costs from these funding sources.

NYS DOH anticipates the DWSRF program will be able to provide approximately $802 million in interest-free or low-interest rate financing and additional subsidy for drinking water project costs from these funding sources.

Eligible entities seeking CWSRF funds must:
· List or update their project using the Project Listing and Update System (PLUS), available at https://plus.efc.ny.gov;
· Submit an approvable engineering report consistent with the Engineering Report Outline on NYS EFC's website at www.efc.ny.gov; and
· Submit a completed Smart Growth Assessment Form.

Eligible applicants seeking DWSRF funds must:
· List or update their project by submitting a project listing form to NYS DOH at: [email protected].;
· Submit an acceptable engineering report generally consistent with the Drinking Water Engineering Report Outline; and
· Submit a completed Smart Growth Assessment Form.
· DWSRF Project Listing Form and Engineering Report Outline are available at www.health.ny.gov/environmental/water/drinking/water

These items must be submitted to NYS EFC (for CWSRF) or NYS DOH (for DWSRF) no later than Friday, June 14, 2024 to have a project listed on the Annual List in the 2025 IUP and be eligible to compete for funding.Municipalities with projects listed on the 2024 CWSRF IUP and that receive notification that they are required to provide project updates must submit the updates using PLUS no later than Friday, June 14, 2024.

If these items are not received by the Friday, June 14, 2024, deadline, the project will not be eligible for funding in FFY 2025 or listed in the IUPs. Projects will not be added to the IUPs between the Draft and Final IUP.

Please note funds are subject to additional federal funding requirements.

Eligible Projects:

CWSRF Base and General Supplemental - Municipal water pollution control projects eligible for interest-free or low-interest rate financing and additional subsidy under Section 212 of the Clean Water Act (CWA) include, but are not limited to: wastewater treatment facilities, pumping stations and sewers, combined sewer overflow abatement; stormwater pollution abatement; and other municipally-owned projects or portions of projects that maintain, protect or improve water quality.

Municipal and non-municipal entities are eligible for CWSRF interest-free or low-interest rate financing and additional subsidy for non-point source projects that protect water quality under CWA Section 319 or implement an approved National Estuary Plan under CWA Section 320. Projects include but are not limited to: green infrastructure; landfill leachate collection, storage and treatment; stormwater management facilities and equipment; wetland and waterbody restoration; deficient or failing decentralized septic systems; or other non-point source projects to maintain, protect or improve water quality under Section 319.

CWSRF EC - Municipally-owned projects or components of projects that address emerging contaminants, including but not limited to, groundwater or surface water contamination caused by perfluoroalkyl and polyfluoroalkyl substances (PFAS), pharmaceuticals, personal care products, and Microplastics/Nanoplastics. All projects in this category must be otherwise eligible for CWSRF financing.

All funding available through this category will be provided as additional subsidy in the form of grants.

DWSRF Base and General Supplemental - Projects must be DWSRF eligible. Municipally-owned and privately-owned community water systems and non-profit, non-community water systems may be eligible for DWSRF subsidized financing or additional subsidy. Projects eligible for DWSRF financing include: construction, rehabilitation, and upgrading of water treatment plants; transmission and distribution mains; storage facilities; pump stations; rehabilitation or development of new drinking water sources; consolidation of water supply services; and capital investments to improve security of drinking water systems.

It is expected that not less than $58,067,870 of the available funding will be provided as additional subsidy in the form of grants. Program details will be provided in the upcoming FFY 2025 Draft IUP.

DWSRF EC - Projects must be otherwise DWSRF eligible and the primary purpose must be to address emerging contaminants in drinking water, with a focus on perfluoroalkyl and polyfluoroalkyl substances (PFAS).

All funding available through this category will be provided as additional subsidy in the form of grants. Program details will be provided in the upcoming FFY 2025 Draft IUP.

DWSRF LSLR - Projects must be otherwise DWSRF eligible and be a LSLR project or associated activity directly connected to the identification, planning, design, and replacement of lead service lines. Any project funded under this category involving the replacement of lead service lines must replace the entire lead service line (public and privately owned portion), not just a portion.

It is expected that not less than $60,760,000 of the available funding will be provided as additional subsidy in the form of grants. Program details will be provided in an amendment or supplement to the FFY 2025 IUP.

NYS EFC and NYS DOH will host at least one webinar to present information on program details and available funding opportunities.
