Issue of election of candidate of judges nominated for vacant position of judge of Civil Chamber of Court of Cassation debated
On October 25, the National Assembly continued the work of regular sittings and adopted the legislative initiatives debated the previous day by voting.
Afterwards, the Parliament debated the issue of electing the candidate of judges nominated for the vacant position of the judge of the Civil Chamber of the Court of Cassation.
The Supreme Judicial Council nominated the candidacy of Karen Tumanyan, Naira Hovsepyan and Gurgen Malkhasyan for the vacant position of judge of the Civil Chamber of the Court of Cassation.
The Chairman of the Supreme Judicial Council Karen Andreasyan presented the biographical data and career paths of the candidates nominated for the vacant position of judge of the Civil Chamber of the Court of Cassation.
The candidate Karen Tumanyan has 22 years of professional experience, teaches at the Vanadzor State University Foundation, is the Founder-Director of the Tumanyan law office.
He stated that the independence of the judiciary is one of the cornerstones of democracy. According to him, the Court of Cassation plays an important role in the development of democracy with a fair trial.
The next candidate Naira Hovsepyan graduated from Yerevan State University, the Faculty of Law and post-graduate studies, has 31 years of professional experience, 27 of them as a judge. She is a judge of the Civil Court of First Instance of General Jurisdiction of Yerevan, a member of the Supreme Judicial Council.
The candidate stated in her speech that the Court of Cassation should ensure the uniform application of the law and conduct a fair trial.
The question of the deputy of the NA Civil Contract Faction Gevorg Papoyan referred to the cooperation between different branches of the Government. In response, it was noted that the principle of legality should apply to the three branches of the Government.
The candidate Gurgen Malkhasyan has 29 years of professional experience, he is the Deputy Director of Malkhasyants Advocacy Center LLC, and since 2023 he has been a judge of the General Jurisdiction Court of First Instance of Shirak region.
He presented observations on the fair trial, the activity of the Court of Cassation and the decisions made. According to him, the Court of Cassation is the court of law.
The question of the deputy of the NA Civil Contract Faction Babken Tunyan related to the delay in court cases regarding the economy. He wondered what possibilities the candidate sees in order to finish the trial of those cases on time.
In response, it was mentioned that legislative amendments are necessary regarding this matter.
The deputy of the NA Civil Contract Faction Arusyak Julhakyan inquired why the candidate decided to be promoted.
"I have passed the threshold necessary for a judge of First Instance" Gurgen Malkhasyan answered.
During the exchange of ideas, the Head of the NA Civil Contract Faction Hayk Konjoryan in his speech referred to the questions and observations raised by his opposition colleagues the previous day. He considered it unacceptable to target any judge or any candidate.
"The Republic of Armenia is a legal state, and the judicial system must be free from influences," Hayk Konjoryan said. He also sent a message to the judges, the representatives of the judicial system, urging them not to give in to pressures and threats.
The speaker also referred to the unelected candidates and stated that they are evaluated by the system. "We have had candidates who received zero votes but were elected in the next election. We will have it in the future as well, because this is not a game for us, this is a process of improving the judiciary and I am convinced that the candidates who came here are all sufficiently prepared, all of them are worthy and appreciated. We believe that we are strengthening the rule of law, the stability of the judicial system and the legal system in the RA both with this debate and with our election," the Head of the Faction stated.
In their final speeches, the candidates thanked the legislative power for the purposeful and concerned debates.
