Buffalo Man Arraigned on Felony Charges for Firing Illegal Gun in City's Broadway-Fillmore Neighborhood

Acting Erie County District Attorney Michael J. Keane announces that 25-year-old Daevon M. Roberts of Buffalo was arraigned this morning before Buffalo City Court Judge Shannon M. Heneghan on one count of Criminal Possession of a Weapon in the Second Degree (Class "C" violent felony), one count of Reckless Endangerment in the First Degree (Class "D" felony) and one count of Criminal Mischief in the Third Degree (Class "E" felony).

It is alleged that on Monday, April 22, 2024, at approximately 7:15 p.m., Buffalo Police officers responded to the area of Memorial Drive and Sweet Avenue for a report of shots fired. The defendant allegedly displayed a handgun during an altercation with another individual and recklessly fired shots as the victim drove away, causing damage to the vehicle. The defendant allegedly drove away from the scene after the incident.

Roberts is scheduled to return on Monday, April 29, 2024 at 9:30 a.m. for a felony hearing. He was held without bail.

If convicted of the highest charge, Roberts faces a maximum sentence of 15 years in prison.

Acting DA Keane commends the Buffalo Police Department Gun Violence Unit for their work in this investigation.

The case is being prosecuted by Assistant District Attorney William Fitzgerald of the Felony Trials Bureau and Assistant District Attorney Jamie E. Englerth of the Buffalo City Court Bureau.

As are all persons accused of a crime, the defendant is presumed innocent until proven guilty in a court of law.
