President Biden’s Veto Sticks it to Small Business During “National Small Business Week”

Washington, D.C. - National Small Business Week is nearing a close and rather than end on a positive note for America's small businesses, President Joe Biden ended the week as he started, by announcing a policy action that undermines American small businesses and entrepreneurial opportunity. Today, President Biden vetoed a resolution (H.J. Res 98) that passed on a bipartisan basis in the House and Senate to overturn the National Labor Relations Board's (NLRB's) expansive and costly new joint employer standard. Small Business & Entrepreneurship Council (SBE Council) president & CEO Karen Kerrigan issued the following statement in response:

"President Biden has clearly communicated where small business stands in his Administration. The President continues to favor radical special interests and policies over Main Street America, as the gush of new regulations is undercutting entrepreneurs at every turn. However, nailing small businesses during a week that is supposed to uplift their value and importance is really, really low. The joint employer rule not only eviscerates the independence of more than 800,000 small business franchise owners in the country, it will burden a vast number of small businesses across various industries."

"Thankfully a district court recently ruled the NLRB exceeded its scope of authority and violated a federal statute by not responding to the economic harm the expanded rule would impose. It is clear that abiding by federal government rules when it comes to crafting new regulations that impact small businesses is not important to the Biden Administration. The agencies habitually crank out new rules without following the rules. Biden officials simply do not care, and again, thankfully their arrogance is being checked by the courts. The cumulative effect of this arrogance will not be viewed kindly by small business come Election Day. But sadly, and in between, jobs and entrepreneurial opportunity will be significantly harmed by President Biden's regulatory rampage, which now includes today's National Small Business Week punch to the gut."
