Planned Parenthood Statement on Fifth Circuit Oral Arguments on Partial Appeal in Baseless Case Trying to Shut Down Planned Parenthood

For Immediate Release: March 13, 2024

NEW ORLEANS - Today, Planned Parenthood Federation of America (PPFA) issued the following statement after a three-judge panel on the Fifth Circuit heard oral arguments in PPFA's pre-trial appeal concerning the politically motivated and meritless False Claims Act case brought against PPFA and three Texas Planned Parenthood affiliates.

The case is expected to go to trial later this year.

Statement from Susan Baker Manning, General Counsel, Planned Parenthood Federation of America:

"As we explained to the court, the legal theory advanced by the plaintiffs is an unprecedented effort to bend the law and attack Planned Parenthood for its unwavering commitment to providing essential health care to patients in Texas and across the country.

"More than 2 million people rely on Planned Parenthood non-profit health centers for high-quality, affordable care. This baseless case has a clear goal: to further a political agenda, block patients from getting sexual and reproductive health care, and shut down Planned Parenthood health centers. The Texas Planned Parenthood affiliates followed the law and did not commit Medicaid fraud. The court should follow the facts and the law and reject these meritless claims.

"The nearly 600 Planned Parenthood health centers across the country will continue to tirelessly serve their communities, and remain focused on protecting access to sexual and reproductive health care."
