Village of Wappingers Falls - Adoption of Local Law 3 of 2023 to Amend the Village Code Consistent with the Comprehensive Plan

Negative Declaration

Dutchess County - The Village of Wappingers Falls Board of Trustees, as lead agency, has determined that the proposed Adoption of Local Law 3 of 2023 to Amend the Village Code consistent with the Comprehensive Plan will not have a significant adverse environmental impact. The action involves adopting of a Local Law to amend the Village Code consistent with the Comprehensive Plan by deleting Chapter 151 entitled "Zoning" in its entirety and replacing it with a new Chapter 151 that: amends the Zoning Map to align it more closely with existing development conditions; amends the Use Table; adds provisions for wireless telecommunications, short-term rentals, live-work dwellings, accessory dwellings, day care centers, electric vehicle charging stations, cannabis dispensaries, parking structures, assisted living facilities, and specific standards for a variety of other uses; adds provisions for an existing Historic Overlay District and a proposed Aquifer and Wellhead Protection Overlay District; adds form-based standards for streetscapes, building design and infill; amends the outdoor lighting provisions, and the requirements for signage, off-street parking, and landscaping; amends the provisions for special use permits and site plan review; and makes other related amendments, including amendments to Chapters 47, 110, and 132. The Local Law deletes Chapter 92 (Mobile Homes), and replaces Chapter A154 with a new Chapter 76 (Fees). It adds new Chapters 76 (Escrow), 85 (Food Trucks), and 124 (Short-Term Rentals). The project is located throughout the Village of Wappingers Falls, New York.
