Gallagher Statement on Unconstitutional Extension of Eviction Moratorium

WASHINGTON, D.C. - Rep. Mike Gallagher (R-WI) today released the following statement after the Biden Administration announced it would extend a federal moratorium on evictions, something that President Biden himself admitted he did not have the constitutional authority to do.

'The CDC does not have the authority to extend this eviction moratorium. Supreme Court Justice Brett Kavanaugh said as much, and President Biden agreed. Democrats chose to disregard Rep. McHenry's responsible solution to address this problem and instead find themselves making a brazenly unconstitutional effort to compensate for their own failures. This is a mess, and as Rep. Ocasio-Cortez pointed out, Democrats have no one but themselves to blame.'

In June, Rep. Patrick McHenry (R-NC), Ranking Member of the House Financial Services Committee, led all committee Republicans in introducing H.R. 3913, the Renter Protection Act, which would fix the Biden Administration's mismanagement of the ERA programs, get rental assistance money out the door quickly, and keep Americans in their homes.
