Accused Gunman Indicted for Shooting Three Victims in North Buffalo

Erie County District Attorney John J. Flynn announces that 30-year-old Caron D. Fleming of Buffalo was arraigned this morning before Erie County Court Judge Kenneth Case on an indictment charging him with two counts of Attempted Murder in the Second Degree, one count of Assault in the First Degree (Class "B" violent felonies), one count of Criminal Possession of a Weapon in the Second Degree (Class "C" violent felony) and one count of Assault in the Second Degree (Class "D" violent felony).

It is alleged that on Saturday, January 6, 2024, at approximately 1:54 a.m., Buffalo Police officers responded to a shooting on the 1100 block of Hertel Avenue. The defendant is accused of intentionally shooting three victims multiple times with an illegal handgun. All three victims were taken by ambulance to ECMC. Two victims, both 28-year-old men, were treated and released from the hospital. One victim, a 36-year-old male, was hospitalized with serious physical injuries.

Fleming is scheduled to return on Thursday, June 6, 2024 at 9:30 a.m. for a pre-trial hearing. He was held without bail.

If convicted of the highest charge, Fleming faces a maximum sentence of 25 years in prison.

DA Flynn commends the Buffalo Police Department Gun Violence Unit for their work in this investigation.

The case is being prosecuted by Assistant District Attorney John G. Schoemick of the Major Crimes Bureau.

As are all persons accused of a crime, the defendant is presumed innocent until proven guilty in a court of law.
