Assinatura de Memorando de Entendimento com a Autoridade Intergovernamental para o Desenvolvimento (IGAD)

No contexto da participação do Presidente Luiz Inácio Lula da Silva na 37ª Cúpula de Chefes de Estado e de Governo da União Africana, em Adis Abeba, foi assinado hoje, 16 de fevereiro, Memorando de Entendimento com a Autoridade Intergovernamental para o Desenvolvimento (IGAD, na sigla em inglês), uma das oito organizações regionais reconhecidas pela União Africana.

Fundada em 1986, seu mandato abrange a harmonização macroeconômica, infraestrutura e transportes, meio ambiente e prevenção de conflitos. Formada por oito membros (Djibuti, Eritreia, Etiópia, Quênia, Somália, Sudão, Sudão do Sul e Uganda), que têm na agricultura o setor econômico mais importante, a IGAD reúne população de cerca de 230 milhões de pessoas.

Por meio do Memorando firmado, o Brasil reforça o apoio à estratégia 2021-2025 da IGAD para segurança alimentar e combate à desertificação.

MEMORANDUM OF UNDERSTANDING Between THE INTERGOVERNMENTAL AUTHORITY ON DEVELOPMENT (IGAD) and THE FEDERATIVE REPUBLIC OF BRAZIL (Brazil) on PARTNERSHIP AND COOPERATION

THE FEDERATIVE REPUBLIC OF BRAZIL

And

THE INTERGOVERNMENTAL AUTHORITY ON DEVELOPMENT (IGAD)
(hereinafter referred to as "Participants")

RECOGNIZING the importance of the IGAD as a Regional Economic Community established with the aim to accelerate regional economic, social, environmental and political integration, and cross border cooperation among its Member States;

IN THE SHARED DESIRE AND COMMITMENT of the Participants as prerequisites for building resilience and economic and social development;

CONVINCED OF the urgency to lay emphasis on sustainable development;

RECOGNIZING the reciprocal advantages of technical cooperation in areas of common interest and the relevance of promoting South-South cooperation based on the horizontal exchange of knowledge and experiences to tackle mutual challenges;

Hereby agree to enter into a Memorandum of Understanding (hereinafter referred as "MoU") under the following terms:

Paragraph 1
Purpose
1) This MoU will establish a joint Partnership
2) and Cooperation Platform to strengthen the institutional relationship and enhance the engagement between the Participants.
3) The Partnership and Cooperation Platform will stimulate the implementation of IGAD and Brazil strategic objectives through actions the Participants agree to undertake.

Paragraph 2
Areas of Cooperation
The Participants will strive to strengthen the linkages of activities of IGAD and Brazil in the areas prioritized by the Participants. The priority areas of technical cooperation will be agreed by means of an Action Programme.

Paragraph 3
Modes of Cooperation
1) The Participants will have regular exchange of information and joint reviews of the Action Programme. These exchanges and reviews will take place in the meetings of the Focal Points of the Participants.
2) In all areas of cooperation set out by the Action Programme, the Participants may consider making voluntary non-binding contributions through the appropriate financial mechanism, observing the rules and regulations of the Participants.
3) In particular and depending on the area of cooperation, IGAD will support:
a. the formulation of regional policies and programs;
b. the harmonization of national policies and programs, and respective cross-border activities;
c. the implementation of IGAD policies, programs and projects at the regional and country levels;
d. enhancement of IGADs institutional capacities.

Paragraph 4
Coordination
1) Both Participants will designate Focal Points responsible for the implementation of this MoU.

2) The designated Focal Points may meet twice a year, on a date and at a location to be decided through diplomatic channels and based on the availability of funds.

Paragraph 5
Privileges and Immunities
Nothing in this MoU will be directly or indirectly interpreted as affecting the privileges and immunities of the two Participants.

Paragraph 6
Modifications and Settlement of Disputes
1) Any modifications or amendments to this MoU will be done in writing with the consent of both Participants.
2) Any dispute arising from this MoU or its interpretation will be settled by negotiation between the Participants.

Paragraph 7
Duration and Termination
1) This MoU will cover an initial period of three (3) years from the date of signature, where after it will be reviewed, if necessary, modified and extended.
2) Either Participant will have the right to terminate the MoU by giving six months written notice.
3) Notwithstanding the preceding, either Participant can terminate the MoU with immediate effect due to the legal imposition of their respective rules and regulations.

Paragraph 8
Compliance Statement
In their Cooperation for the implementation of this MoU, both Participants undertake to comply with international standards of transparency and accountability, the principle of "do no harm" and human rights.

Paragraph 9
Entry into Force
1) This MoU will be effective upon signature by both Contracting Participants;
2) This MoU will not create any obligations for the Participants, and their activities must be implemented in accordance with the applicable laws, regulations, and rules of each Participant;
3) The MoU is written in two original copies in the English language;
4) The Contracting Participants herewith confirm and sign this MoU.

RECONHECENDO a importância da IGAD como Comunidade Econômica Regional criada com o objetivo de acelerar a integração econômica, social, ambiental e política da região e a cooperação transfronteiriça entre os seus Estados-Membros;

NO DESEJO E COMPROMISSO COMPARTILHADOS dos Partícipes como pré-requisitos para a construção de resiliência e desenvolvimento econômico e social;

CONVENCIDOS DA urgência de dar ênfase ao desenvolvimento sustentável;

RECONHECENDO as vantagens recíprocas da cooperação técnica em áreas de interesse comum e a relevância de promover a cooperação Sul-Sul baseada no intercâmbio horizontal de conhecimentos e experiências para enfrentar desafios mútuos;

Pelo presente, concordam em celebrar um Memorando de Entendimento (doravante denominado "MdE") nos seguintes termos:

Parágrafo 1
Propósito
1) Este MdE estabelecerá uma parceria conjunta
2) e Plataforma de Cooperação para fortalecer o relacionamento institucional e aumentar o engajamento entre os Partícipes.
3) A Plataforma de Parceria e Cooperação estimulará a implementação dos objetivos estratégicos da IGAD e do Brasil por meio de ações que os Partícipes concordam em empreender.

Parágrafo 2.º
Áreas de Cooperação
Os Partícipes se esforçarão para fortalecer os vínculos das atividades da IGAD e do Brasil nas áreas priorizadas pelos Partícipes. As áreas prioritárias de cooperação técnica serão acordadas por meio de um Programa de Ação.

Parágrafo 3.º
Modos de Cooperação
1) Os Partícipes realizarão trocas regulares de informações e análises conjuntas do Programa de Ação. Esses intercâmbios e análises ocorrerão nas reuniões dos Pontos Focais dos Partícipes.
2) Em todas as áreas de cooperação estabelecidas no Programa de Ação, os Partícipes podem considerar a possibilidade de fazer contribuições voluntárias não vinculantes por meio do mecanismo financeiro apropriado, observadas as normas e regulamentos dos Partícipes.
3) Em particular, e dependendo da área de cooperação, a IGAD apoiará:
a. a formulação de políticas e programas regionais;
b. a harmonização de políticas e programas nacionais e respectivas atividades transfronteiriças;
c. a implementação de políticas, programas e projetos da IGAD a nível regional e nacional;
d. reforço das capacidades institucionais da IGAD.

Parágrafo 4.º
Coordenação
1) Ambos os Partícipes designarão Pontos Focais responsáveis pela implementação deste Memorando de Entendimento.
2) Os Pontos Focais designados poderão se reunir duas vezes por ano, em data e local a serem definidos pelos canais diplomáticos e com base na disponibilidade de fundos.

Parágrafo 5.º
Privilégios e Imunidades
Nada neste MdE será interpretado, direta ou indiretamente, como afetando os privilégios e imunidades dos dois Partícipes.

Parágrafo 6.º
Modificações e Resolução de Disputas
1) Quaisquer modificações ou alterações a este MdE serão feitas por escrito com o consentimento de ambos os Partícipes.
2) Qualquer disputa decorrente deste MdE ou de sua interpretação será resolvida por negociação entre os Partícipes.

Parágrafo 7.º
Duração e Extinção
1) Este MdE cobrirá um período inicial de três (3) anos a partir da data de assinatura, após os quais será revisado, se necessário, modificado e prorrogado.
2) Qualquer um dos Partícipes terá o direito de rescindir o MdE mediante notificação por escrito com seis meses de antecedência.
3) Não obstante o acima exposto, qualquer um dos Partícipes pode rescindir o MdE com efeito imediato em função de imposição legal das respectivas normas e regulamentos.

Parágrafo 8.º
Declaração de conformidade
Na sua cooperação para a implementação deste Memorando de Entendimento, ambos os Partícipes comprometem-se a cumprir as normas internacionais de transparência e prestação de contas, o princípio de "não causar danos" e os direitos humanos.

Parágrafo 9.º
Produção de efeitos
1) Este MdE produzirá efeitos após a assinatura por ambos os Partícipes Contratantes;
2) Este MdE não criará quaisquer obrigações aos Partícipes e suas atividades devem ser implementadas de acordos com as leis, regulamentos e regras aplicáveis de cada Partícipe;
3) O MdE é redigido em duas vias originais no idioma inglês;
4) Os Partícipes Contratantes confirmam e assinam este MdE.
