New Board action regarding PERB-issued EERA/HEERA factfinding contracts; information requested for MMBA/EERA/HEERA factfinding cases
First, on behalf of PERB, we want to thank all of you who have served as a Chair for a factfinding panel in the past. Your services are deeply appreciated. Below you will find information regarding recent Board action on Factfinding contracts and a request for information.
A. Board Increases the Number of Days for PERB-issued EERA/HEERA Factfinding Contracts
On June 8, 2023, the Board voted that effective July 1, 2023 for all new PERB contracts executed that day or thereafter, PERB will now be able to pay the rate of $1,300.00 per day, for a maximum of seven (7) days. (Previously, the maximum number of days was five (5).) This action has no impact on those cases where the parties jointly select their own Chair of a factfinding panel under EERA or HEERA.
If you are not already on our EERA/HEERA list and would like to be considered when PERB contracts with the Chair for an EERA/HEERA factfinding panel in the future, please contact Deputy General Counsel Wendi Ross at [email protected].
B. We Need Your Updated Resumes and Confirmation that You Want to Continue to be on PERB's Various Factfinding Lists
Many of you have old resumes on file with PERB. Please remember that payment for your services as a Chair of a factfinding panel is dependent on the resume "on file" with PERB. (Gov. Code, §§ 3548.3(c), 3505(c).)
In addition, PERB's listing of available individuals who are willing to serve as Chairs for MMBA, EERA and HEERA factfinding cases appear to contain names of some who have now retired. On or before July 21, 2023, please confirm that you would like to continue having your name included on PERB's factfinding lists by sending an e-mail message to: [email protected].
C. PERB is Looking for More Potential Chairs to Provide Factfinding Services
If you know someone who is interested in participating in PERB's factfinding program, please have them send their contact information to: [email protected]. An application package will be sent to them to complete.
