Defendant Sentenced to 580 Yrs. Prison for Sexually Assaulting 7 Children

The Honorable Matthew Gary sentenced Kirby Torres to 580 years to life in state prison. On October 12, 2023, a jury convicted Torres of five counts of committing lewd acts on a child under the age of 14 with force or fear and 19 counts of committing lewd acts on a child under 14 years old. The jury also found true that Torres took advantage of a position of trust; all seven victims were particularly vulnerable at the time of the offenses; the crimes involved great violence or acts disclosing a high degree of cruelty, viciousness, or callousness; the crimes involved planning, sophistication and professionalism; and Torres used obscene or harmful material to encourage the children to participate in the sex acts. The jury further found that Torres committed lewd acts against more than one child under 14 years old and that he is a serious danger to society.

Between 2010 and 2020, Torres sexually assaulted seven children (boys and girls) between the ages of 3 and 13 years old, committing a variety of acts involving substantial sexual conduct. The abuse ended when a babysitter overheard one of the child victims talking about sexual conduct with Torres. After a thorough investigation by the Sacramento County Sheriff's Office and the Citrus Heights Police Department, Torres was arrested.

Torres was arrested in 2020 at age 35 and has earned actual custody credit since that time. Under current California law, he will become eligible for release at an Elder Parole hearing once he reaches the age of 50 and only serves 20 years of his 580-year sentence.
