Project Description:

The Department has prepared a draft permit and has made a tentative determination, subject to public comment or other information, to approve a proposed withdrawal and discharge of up to 2,880,000 gallons per day of treated groundwater into Upper New York Bay, a Class 1 waterbody. Dewatering is required for the construction of a substation which requires piles/pile caps for construction and installation of a new conduit cable. The work will be in two distinct work areas (Part 1 and Part 2) so there will be two treatment systems and discharge locations.

Part 1 dewatering will be conducted through sump pumps with a maximum discharge rate of 1,440,000 gallons per day (GPD) and up to six (6) pits will be dewatered at any time for a total of up to 1,440,000 GPD. Tri-State Groundwater (TSGS) will install 6" Sch 40 PVC discharge piping to connect the dewatering system to the discharge location. The point of discharge will be a combined sewer overflow via an existing connection that leads to outfall OH-022 to Gowanus Bay.

Part 2 dewatering will be conducted through a system of ten (10) 12-inch deep wells to be installed at a depth of forty (40) feet. Sumps will be utilized as needed. The maximum discharge rate will be 1,440,000 GPD. TSGS will install 6-inch Sch 40 PVC discharge piping to connect the dewatering system to the discharge location. The discharge point will be an existing sewer overflow pipe on 2nd Ave between 28th and 29th Streets. The sewer leads to Outfall OH-025 to Gowanus Bay.

Requests for a legislative (public statement) hearing must be sent in writing to the DEC contact person below by the comment deadline. The Department assesses such requests pursuant to 6 NYCRR Section 621.8.

Availability of Application Documents:

State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed and cultural resources were identified. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no adverse impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.
